Parts 105 through 175 cover the transportation of hazardous materials. A person who knowingly violates a requirement of the Federal hazardous material transportation law, an order issued thereunder, this subchapter, subchapter C of this chapter, or an exemption issued under this subchapter applicable to the transporting of hazardous materials or the causing of them to be transported or shipped is liable for a civil penalty of not more than $32,500 and not less than $275 for each violation. When the violation is a continuing one, each day of the violation constitutes a separate offense. 107.329(a) A person who knowingly violates § 171.2(g) or willfully violates a provision of the Federal hazardous material transportation law or an order or regulation issued thereunder shall be fined under title 18, United States Code, or imprisoned for not more than 5 years, or both. 107.333 All hazardous materials must be labeled. It may be shipped, but it requires shipping papers, labeling, marking, etc. as COMPRESSED GAS, NOS. If an appropriate technical name is not shown in the table, selection of a proper shipping name shall be made from the generic or NOS (Not Otherwise Specified) descriptions corresponding to the specific hazard class, packing group, or subsidiary hazard, if any, for the material. 172.101 105 "Forbidden" means as implied and if listed in both columns, the material may not be transported by air. Some substances are forbidden to be carried on passenger carrying flights but may be carried on "Cargo Only Flights". 172.101 107 Part 175 is entitled "Carriage by Aircraft". Subpart A - general information and regulations. Subpart B - loading, unloading, and handling. Subpart C - specific regulations applicable according to classification of material. It is the shipper’s responsibility to ensure that he has complied with Parts 172 and 173 of CFR 49. Before accepting a restricted article for shipment the air carrier must check to be sure that the shipper has, in fact, complied with the regulations. The specific wording of the notice is found in CFR 49, 175.25. The notice shall be prominently displayed in each location at an airport where the aircraft operator issues tickets, checks baggage, and maintains aircraft boarding areas. Reportable discrepancies are listed in 175.31 and should be made to the FAA Civil Aviation Security Field Office. The telephone report should include: Name and telephone number of the person reporting the discrepancy. Name of the aircraft operator. Specific location of the shipment concerned. Nature of the discrepancy The pilot in command must be given all the known details of the shipment. 175.33 175.35 (2) Described and certified on a shipping paper prepared in duplicate in accordance with part 172 of this subchapter or as authorized by § 171.11 of this subchapter. Each person receiving a shipping paper required by this section must retain a copy or an electronic image thereof, that is accessible at or through its principal place of business and must make the shipping paper available, upon request, to an authorized official of a federal, state, or local government agency at reasonable times and locations. For a hazardous waste, each shipping paper copy must be retained for three years after the material is accepted by the initial carrier. For all other hazardous materials, each shipping paper copy must be retained for 375 days after the material is accepted by the carrier. Each shipping paper copy must include the date of acceptance by the carrier. The date on the shipping paper may be the date a shipper notifies the air carrier that a shipment is ready for transportation, as indicated on the airbill or bill of lading, as an alternative to the date the shipment is picked up or accepted by the carrier. Only an initial carrier must receive and retain a copy of the shipper"s certification, as required by § 172.204 of this subchapter. 175.30(a)(2) Lost or detached labels for packages of hazardous materials must be replaced in accordance with the information provided on the shipping papers. An adequate supply of labels specified in Subpart E of Part 172 of CFR 49 should be maintained at each shipment loading location. 175.40 During loading and unloading no person may operate any device capable of causing a spark within 50 feet of the aircraft. In any accessible cargo compartment in a cargo aircraft only in a manner that makes it inaccessible unless in a freight container. 175.75(a) 644 When other means of transportation are impracticable or unavailable, a single pilot cargo only flight may carry hazardous material in a nonaccessible cargo compartment with no regulatory limit. The amount is only limited by the cargo compartment weight and loading limitations. 175.85(c)(3) 647 (a) A hazardous material bearing a POISON, POISON INHALATION HAZARD, or INFECTIOUS SUBSTANCE label may not be carried in the same compartment of an aircraft with material which is marked as or known to be a foodstuff, feed, or any other edible material intended for consumption by humans or animals unless either the Division 6.1 (poisonous) material or material in Division 6.2 (infectious substance) and the foodstuff, feed, or other edible material are loaded in separate unit load devices which, when stowed on the aircraft, are not adjacent to each other, or the Division 6.1 (poisonous) material or material in Division 6.2 (infectious substance) are loaded in one closed unit load device and the foodstuff, feed or other material is loaded in another closed unit load device. 175.630 Division 1.1. or 1.2 (Class A) detonators and detonating primers are permitted only when no other hazardous material is aboard the aircraft. See other qualifications and special authorization under paragraph 175.320(a) - see table. 650 Division 1.4 (Class C) explosives are permitted when there are no Division 1.4 (Class A) explosives aboard the aircraft. See other qualifications and special authorization under paragraph 175.320(a) - see table. 650 (c) Initial and recurrent training-- (1) Initial training. A new hazmat employee, or a hazmat employee who changes job functions may perform those functions prior to the completion of training provided: (i) The employee performs those functions under the direct supervision of a properly trained and knowledgeable hazmat employee; and (ii) The training is completed within 90 days after employment or a change in job function. 172.704 All ATCO certificate holders are required to train each crewmember to recognize hazardous materials by Para. 135.333(c) Medicinal and toilet articles are exempt as long as the total volume does not exceed 70 ounces. Also exempt are most life support items containing oxygen, radioactive materials, batteries, and compressed gas, if certain procedures are followed. 175.25 641 (b) Reportable incident. A telephone report is required whenever any of the following occurs during the course of transportation in commerce (including loading, unloading, and temporary storage): (1) As a direct result of a hazardous material: (i) A person is killed; (ii) A person receives an injury requiring admittance to a hospital; (iii) The general public is evacuated for one hour or more; (iv) A major transportation artery or facility is closed or shut down for one hour or more; or (v) The operational flight pattern or routine of an aircraft is altered. 171.15(b) A package containing liquid hazardous materials not marked as indicated for orientation must be stored and loaded with closures up (other than side closures in addition to top closures.) 175.79(b) 647 Prior approval of the proposed system must be made by the Association Director for Operation and Enforcement.
